Terms of Service

1. Eligibility & Your Account

• You must be at least 16 years old (or the age of digital consent in your jurisdiction, whichever is higher) and able to enter a binding contract.
• You sign in with Google OAuth. You are responsible for keeping your Google account secure; actions taken through your authenticated session are deemed to be yours.
• You agree to provide accurate information (including your real name on your resume) and to keep it current.
• One account per person. You may not share your account or let anyone else use it on your behalf.

2. What PitchRight Does

PitchRight helps job seekers:

• Extract job details from a URL or pasted job description.
• Score and tailor their resume to a specific role.
• Find publicly available recruiter and hiring-manager contact details for the company.
• Draft a personalized outreach email with AI and send it through the user's connected Gmail account.

We may add, change, or remove features at any time. Material changes affecting a paid plan will be notified in advance.

3. Acceptable Use

You agree to use the Service only for lawful, legitimate job-seeking purposes. You will not, and will not attempt to:

• Spam, bulk-mail, or harass — the outreach feature is for sending genuine, personalized job application messages, not mass mailings, newsletters, marketing campaigns, or unsolicited commercial email. You must comply with the CAN-SPAM Act (US), PECR (UK), GDPR (EU), DPDPA (India), and any other applicable anti-spam law.
• Impersonate another person, misrepresent your identity, or submit fraudulent applications, resumes, or references.
• Scrape, resell, or redistribute the recruiter contact data returned by the Service, or build a competing dataset or product from it.
• Violate Google's API Services User Data Policy, the Gmail bulk-sender guidelines, or any Google terms.
• Attempt to access, probe, or test the vulnerability of our systems; reverse-engineer, decompile, or disassemble the Service; or circumvent rate limits, credit allocations, or abuse-prevention mechanisms.
• Use the Service to transmit viruses, malware, phishing content, hateful or discriminatory content, sexually explicit material, or anything illegal in your jurisdiction or the recipient's.
• Use the Service to collect, store, or process personal data about third parties in a way that violates applicable privacy law.

We may suspend or terminate your account without notice for any violation of this section.

4. Google Account & Gmail Sending

When you connect your Google account, you grant PitchRight the OAuth scopes described in our Privacy Policy — currently only openid, email, profile, and gmail.send.

• We send only the outreach email you compose and explicitly approve. We do not read your Gmail inbox, drafts, or sent folder.
• Every email sent through PitchRight appears in your Gmail “Sent” folder and is attributable to you. You are the sender for all legal purposes (anti-spam law, employer communications, etc.).
• You are solely responsible for the content, recipient, and appropriateness of each outreach message. Review every draft before sending.
• You may revoke PitchRight's access at any time at myaccount.google.com/permissions.

5. AI-Generated Content

PitchRight uses AI (currently OpenAI's models) to draft outreach emails and tailor resumes. AI output may be inaccurate, incomplete, or biased, and may reproduce facts or phrasing from its training data. You are responsible for reviewing and editing every AI-generated draft before sending or submitting it. We make no warranty that AI output is suitable for any particular purpose or job application.

6. Credits, Plans & Payments

• Certain actions (such as revealing recruiter emails and running Prospeo contact searches) consume credits. Each plan includes a monthly credit allotment; unused credits do not carry over. You can purchase one-time credit packs on top of an active paid plan.
• Subscription plans renew monthly on the same date, charged automatically through our payment processors (Razorpay for INR; Dodo Payments for USD and INR). Prices are shown on the pricing page and may include local taxes (e.g. 18% GST for India).
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing cycle, and you keep access until then.
• Refunds are governed by our Refund Policy (where present) and applicable consumer-protection law.
• We may change pricing. Price changes will be effective at your next billing cycle, with at least 14 days’ notice sent to the email on your account.
• Chargebacks initiated without first contacting us may result in immediate account suspension.

7. Your Content & Licence to Us

You retain ownership of your resume, job descriptions, email drafts, and other content you provide ("Your Content"). You grant PitchRight a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, transmit, and process Your Content solely as needed to:

• operate, provide, and improve the Service for you;
• send the outreach emails you compose, on your behalf;
• comply with legal obligations (e.g. abuse investigation, retention of payment records).

This licence ends when you delete Your Content or your account, except where retention is legally required or needed to resolve disputes. We do not use Your Content to train generalized AI/ML models. See the Privacy Policy for details on how Google user data is handled.

8. Our Intellectual Property

The Service, including its software, design, logos, brand name "PitchRight", and all content we create or license, is owned by PitchRight and protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Service as a registered user, subject to these Terms. You may not copy, modify, distribute, sell, or create derivative works of any part of the Service without our prior written consent.

9. Third-Party Services

The Service integrates third-party providers — Google, OpenAI, Supabase, Razorpay, Dodo Payments, Prospeo, Hunter.io, Resend, Cloudflare, Google Analytics (see our Privacy Policy for the current list). Each is governed by its own terms of service and privacy policy, and PitchRight is not responsible for third-party conduct, outages, or policy changes. Links to third-party sites or job postings are provided for convenience and do not constitute an endorsement.

10. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that it will result in any job interview, offer, response from a recruiter, or any other career outcome. Recruiter contact details are returned by third-party providers and may be inaccurate or out of date; you are responsible for verifying before sending.

11. Limitation of Liability

To the maximum extent permitted by law, PitchRight and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, goodwill, data, business opportunity, or job opportunity, arising from or related to your use of the Service, even if we have been advised of the possibility of such damages. Our aggregate liability for all claims arising out of or relating to the Service is limited to the greater of (a) the amount you have paid us in the twelve (12) months preceding the event giving rise to the claim or (b) INR 1,000 / USD 15.

12. Indemnity

You agree to defend, indemnify, and hold harmless PitchRight and its personnel from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from (a) your use of the Service in breach of these Terms, (b) your violation of any law or of a third party's rights (including recipients of outreach emails you send), or (c) Your Content.

13. Suspension & Termination

• By you: you may stop using the Service and delete your account at any time. See the Privacy Policy, section 7, for the deletion workflow.
• By us: we may suspend or terminate your access, with or without notice, if you breach these Terms, if we are required to do so by law, or if continued provision of the Service becomes commercially unreasonable.
• Sections that by their nature survive termination (ownership, disclaimers, limitation of liability, indemnity, governing law) will continue to apply after your account ends.

14. Governing Law & Disputes

These Terms are governed by the laws of India, without regard to conflict-of-laws principles. Any dispute arising out of or in connection with these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in Tamil Nadu, India. Nothing in these Terms limits any statutory right you may have under consumer-protection laws of your country of residence that cannot be waived by agreement.

15. Changes to These Terms

We may update these Terms from time to time. If the changes are material, we will give you prior notice by email or in-app notification. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance. If you do not agree to the updated Terms, you must stop using the Service and may delete your account.
